Police Report Details Jan. 25 Incident Involving Police Chief

WARSAW — Warsaw Police Department has released a detailed narrative of the incident involving Warsaw Police Chief Scott Whitaker that is now being reviewed by Indiana State Police.

The reckless driving police report, nearly two pages long, details Whitaker’s version of what happened after he began following a motorist in a blue Honda who he said had nearly struck his vehicle head-on while traveling on CR 200S at about 6:30 p.m. Jan. 25.

The narrative was contained in a police report made available to media earlier today, Feb. 13, and recaps Whitaker’s version in which he contends the motorist nearly struck two other vehicles on CR 200S, drove slowly in a suburb, momentarily drove off the road as it attempted to turn onto another road and appeared to be impaired.

Whitaker was not in uniform and was driving his personal vehicle at the time.

The report also includes Whitaker’s explanation of what happened when he approached a 74-year-old man – later identified as Michael Brander – in a driveway on Chickadee Lane who he believed had been driving.

The report concludes that the vehicle was actually being driven by a 72-year-old woman who later told police that she struggles with nighttime driving.

Whitaker, in the report, says the car was left in the driveway and still running when a yet-to-be identified man approached the car and appeared to be attempting to get back into the vehicle.

Whitaker said he had already pulled into the driveway and approached the man and was attempting to prevent him from getting into the vehicle. In doing so, he grabbed the man’s shoulders from behind.

“I immediately grasped him from behind by the coat on both shoulders and attempted to maneuver him slightly in front of the driver’s door, near the hood area,” the report said. “Upon doing so, (the man’s) legs gave out and he dropped to his knees. I was able to assist him to the ground, as I was still holding his shoulders. At that time, I identified myself as a Warsaw police officer and asked him to keep him hands on the hood of the car and stay in that position” until other officers arrived.

The report says Whitaker then met with a woman identified as Kathleen Brander who said she is the man’s wife. Whitaker explained that he was under the impression that the man had been driving dangerously.

In an effort to show that she had been driving, the woman retold her version of the travels, which Whitaker described as being accurate. She then explained that she normally does not drive at night, but that she had had car trouble while shopping, and that that had delayed her trip home before dark.

“I assumed (he) had been driving the car since he was attempting to access it upon my arrival,” the report said.

Whitaker also noted in his report that when the car arrived home, he was watching from three houses away and that the driver had been silhouetted when exiting the vehicle.

Whitaker was assisted at the scene by another officer from Warsaw Police Department and a deputy from Kosciusko County Sheriff’s Office.

When police told the man that the woman had almost struck Whitaker’s vehicle, the man said he “did not doubt it.”

The report indicates that neither the man or woman appeared to be impaired.

Reports of the incident on social media suggested Whitaker might have been too rough with the man. Warsaw Mayor Joe Thallemer announced on Tuesday that he has asked Indiana State Police to review the situation.
