New Trial Date Set For Woody, DeHart, No Date For Hursey

WARSAW — A pretrial conference of attorneys for Brandon Thomas Woody and Kyle David DeHart was held with Kosciusko Circuit Court Judge Michael Reed this morning, Thursday, April 28 and a new trial date set.

No date has been set for the separate trial of Thomas Glen Hursey.

The three have been charged with the Feb. 19, 2015, Syracuse murders of Joshua R. Knisley and Tara Lynn Thornburg.

For Woody and DeHart, a 12-person jury has been set to begin at 8:30 a.m. Sept. 29. A final pre-conference has been scheduled for 3 p.m. July 28.

The original trial was set to begin today and continue into Friday, restarting Monday and continuing May 2 through May 6.

The continuance was granted April 22, after Lawrence M. Hansen, attorney for DeHart, filed a motion to strike evidence for untimely production of discovery or in the alternative, motion to continue the jury trial. The state, through the prosecutors office, had filed notice of additional discovery on that day.

At this point the trials for Woody and DeHart will be held together.

Hurley will have a pre-trial conference at 3 p.m. July 28.

All three were charged with two counts of felony murder. However DeHart has an additional charge of obstruction of justice, a level 6 felony, and Hursey has additional charges of aiding/inducing robbery resulting in serious bodily injury a level 2 felony and aiding/inducing obstruction of justice, a level 6 felony.
