Jason R. Bontrager, 36, 72833 CR 29, Syracuse, should have discovered if the court accepted his plea agreement Monday morning. But instead, he rescinded his plea of guilty and his case is now set for a jury trial July 21-22.
Bontrager was charged in August 2014 for corrupt business influence, a level 5 felony, and dealing in a synthetic drug or synthetic look-a-like substance, a level 6 felony. Bontrager allegedly distributed the drugs for profit after the production of the drugs by Michelle Stimmel.
On Aug. 28 police received information regarding a plan to distribute a new batch of synthetic drugs. A search warrant was obtained for Bontrager’s residence where a hand gun and small amounts of synthetic drugs were discovered.
Bontrager’s plea agreement, filed with the court on Jan. 19, stated he would plead guilty to the crime of dealing in a synthetic drug with the corrupt business influence charge being dismissed. The plea agreement also called for no more than a 1 1/2-year sentence, any other sentence amount would be suspended. He also agreed to testify against any and all co-defendants, if necessary, and provide a clean-up statement with law enforcement.
Since his plea was withdrawn, a jury will decide if he is guilty of one or both crimes. A level 5 felony carries a penalty of one year to six years. A level 6 felony carries between six months to 2 1/2 years, and could be entered as a class A misdemeanor.
