Former Millersburg Marshal David Kieth Hathaway has been sentenced to one year of probation after pleading guilty to two misdemeanor counts of criminal conversion. Elkhart Superior Court 6 Judge David Bonfiglio also order Hathaway to pay a $300 fine plus court costs.

The charges stem from an incident in which Hathaway was caught on camera sniffing and stealing the underwear of his son’s live-in girlfriend. Hathaway’s son reportedly set up the hidden cameras.

Hathaway has since retired from his position and has undergone a psychology evaluation. He remains a part-time employee of the Millersburg Police Department.
