After four hours of deliberation, the six-man, six-woman jury could not reach a decision against Franklin Engle on count one of sexual misconduct with a minor, a class B felony. They found him not guilty on sexual misconduct with a minor on count two, also a class B felony.

The jury foreman told Kosciusko Superior Court Judge Duane Huffer they were unable to reach a unanimous decision as set forth by the judge. Huffer asked if the court allowed additional time for review of evidence and further deliberation, could a decision be reached?

The foreman stated, “afraid not. We’re deadlocked.”
