StaceyPageOnline.com has obtained the probable cause affidavit in the D felony aggravated battery case against Garret Joe Swanson, 28, of Warsaw. Swanson is charged with aggravated battery in an attack on Nicholas Phillips, 28, Warsaw.

According to the court document, a witness in the case, Ryan Schultz, told Warsaw Police Det. Steve Adang that people were arm wrestling inside Rex’s Rendezvous on the night of May 18. Those people were allegedly competing for $1,000, a claim that could result in additional charges.

Schultz told police that Phillips approached Swanson inside the bar and told him he would fight him for $10,000. Swanson allegedly told Phillips to go outside.

The affidavit says Swanson punched Phillips in the face, then removed his shirt and got into a nearby vehicle. Phillips allegedly approached the vehicle when Swanson got out and again punched Phillips in the face, then ran.

Warsaw Police Officer Jonathan Rice observed Swanson hit Phillips, who fell to the ground. Officer Rice found Phillips unconscious and called for medical assistance. Phillips remains in Lutheran Hospital in serious condition allegedly suffering from a broken jaw, broken nose and bleeding on the brain.

In the probable cause affidavit, Det. Adang writes that Warsaw Police Officer Brian Hupp also arrived on the scene and identified Swanson, who ran back into Rex’s Rendezvous and out a back exit. When Swanson was contacted via telephone, he initially denied being at the bar.

Swanson has obtained Brad Voelz as his defense attorney. An initial hearing set for today was waived and Swanson will now appear in Kosciusko Superior Court 1 on June 11 when he will have a status conference. A pretrial hearing is set for 8:30 a.m. Thursday, July 26.

Authorities have said they charged Swanson with the class D felony in part to his background in mixed martial arts fighting.
