Motorist Avoids Criminal Charge In Fatal Husky Trail Accident

The Kosciusko County Grand Jury decided not to indict the motorist for reckless homicide after the vehicle she was driving struck and killed eight-year-old Gidieon Cook. InkFreeNews photo by Dan Spalding.

WARSAW — A Kosciusko County Grand Jury that reviewed circumstances in the fatal pedestrian accident on Husky Trail earlier this year has decided not to indict the motorist involved in the accident.

On June 10, Gidieon Cook, 8, was struck and killed while attempting to cross Husky Trial in front of Harrison Elementary. 

Cook, who had just finished second grade at Harrison Elementary School, died a short time after being struck by a vehicle driven by 24-year-old Raven L. Loubert, of Tippecanoe. She was driving a black 2008 Nissan Sentra and had come to a stop on North Pointe Drive before she began to make a left turn onto Husky Trail and struck Gidieon.

Loubert cooperated with investigators and provided a consensual blood draw at the time of the accident and a search of her cell phone. Additionally, multiple witnesses were interviewed who observed the collision and remained on the scene to assist investigators.

As a result of witness interviews, it was learned that Cook had started to run across the street in front of a vehicle preparing to turn left. This caused that vehicle to stop abruptly. The boy then returned to the east side of the intersection and the SUV continued with its left turn. This vehicle, believed to be a white or silver Ford Focus, was in front of the Nissan Sentra driven by Loubert.

Police captured surveillance video of that SUV from the interior feed of a Warsaw Community Schools bus and broadcast through news sources and social media. Investigators, along with assistance from the media, attempted to find the driver of that white or silver Ford for an interview, but attempts proved unsuccessful.

Upon conclusion of the investigation, all information was turned over to the Kosciusko County Prosecuting Attorney’s Office for a review of possible charges. Warsaw Police were recently advised by the Kosciusko County Prosecuting Attorney’s Office that the grand jury decided upon a “no bill,” which means that no indictment for the offense of reckless homicide will be issued.

Gidieon Cook’s family was notified of the jury’s decision prior to Friday’s announcement.
