ELKHART — The family of a former Mary Daly Elementary School student claims the school’s principal and the Elkhart school system failed to stop another student from sexually assaulting their child.

The 6-year-old girl’s parents filed a lawsuit against Elkhart Community Schools and Mary Daly Principal Josh Nice, according to The Goshen News.

The parents said the child was sexually abused and battered by a boy multiple times at the school around August 2017.

The parents met with Nice to discuss the incidents and learned he was already aware of them, according to the lawsuit. The family also alleges Nice took no steps to remove the suspect student from school.

The school district has not responded to the claims.
