WARSAW — A Warsaw man was sentenced in Kosciusko County Superior Court Thursday, Nov. 29, for his part in an assault on another inmate while incarcerated at the Kosciusko County Jail.
Kane Edward Hively, 31, 1228 E. Main St., Warsaw, pleaded guilty to battery causing serious bodily injury, a level 5 felony, today in court. He was originally charged with two counts of attempted rape.
In January 2016, an inmate at the Kosciusko County Jail informed a jail officer that other inmates were assaulting him, choking him, pulling on his genitalia and violating him with various objects. The officer observed bruises on the inmate’s arms and legs. The victim advised that sodomy had occurred on numerous occasions.
The victim told KCSD officers that two other inmates struck him with their fists on a regular basis. In early December 2015, the victim stated that the two inmates came into his cell and wrestled him to the ground while someone tried to violate him with a comb.
He further advised that on Dec. 30, 2015, he was working out and had his legs in the air when someone grabbed his legs, holding them up, while another person pulled his pants down and attempted to violate him with a pop bottle. Officers checked surveillance video, which showed that Hively was the inmate performing the act.
Judge David Cates sentenced Hively to six years at the Indiana Department of Corrections. The sentence was ordered to be served consecutive to sentences imposed in other cases. Hively was given 91 days of jail time credit and ordered to have no contact with the victim.
“You have a substantial criminal history,” said Cates. “You don’t comply with the rules of probation. You don’t comply with the rules of society.”
