KOSCIUSKO — A Warsaw man was sentenced today in the Kosciusko Superior 1 Court on charges related to three separate cases.
Timothy Dmitriy Freeman, 23, 346 Deerwood Court, Warsaw, was found guilty of intimidation, a level 6 felony; criminal confinement, a level 5 felony; battery, a level 5 felony; and possession of methamphetamine, a level 6 felony.
Freeman was arrested Oct. 1, 2017, after fleeing from police. When officers located him the following day, Freeman reportedly was in possession of methamphetamine and a syringe. He was booked into the Kosciusko County Jail on Oct. 14, 2017.
On Oct. 15, 2017, an inmate in the Kosciusko County Jail advised he did not want to go back into the holding cell because four inmates had forced him to put his finger in one of their rectums, stolen his lunch tray, hit him with sandals, kicked him and would not let him use the call button to ask for help. He further advised he was very intimidated and scared to go back into the cell. He identified the four inmates as Freeman, Christopher Orr, Danny Combs and Tyler Martin.
According to the affidavit of probable cause, Martin wanted everyone’s muffins at breakfast and became angry because the victim had eaten part of his. Combs, Martin and Freeman threatened to hurt the victim throughout the day. At one point, Freeman told the victim to put his finger into Freeman’s rectum or he was going to beat him. Orr was going to put toilet paper in front of the camera so Freeman and Martin could hurt him if he did not put his finger in Freeman’s anus.
The victim was then forced to put butter onto his finger and insert his finger into Freeman’s rectum. The victim advised he was scared and intimidated and thought if he did not insert his finger, the men would hurt him. He further advised that Orr dumped a cup of urine on his head, Combs kicked him in the abdomen and Freeman struck him in the face.
An officer within the jail observed the surveillance video. The video showed the actions described by the victim. Phone calls were listened to in which Martin advised he watched a man touch another man’s rectum, Combs advised he made someone touch another person’s rectum and Orr told a female about all the incidents that had occurred.
Sentencing for the two charges in the first case are to be served concurrently; however, sentencing in each case was ordered to be served consecutively. Judge David Cates sentenced Freeman to a combined total of 12 1/2 years in the Indiana Department of Corrections, with one year of that sentence to be suspended and served on probation.
Remaining charges were dismissed, pursuant to the plea agreement.
