WARSAW — A Nappanee man was sentenced Monday, Dec. 11, in the Kosciusko County Circuit Court, after admitting to breaking into a home in Kosciusko County.
Jeffrey Donald Sandoval, Nappanee, pleaded guilty to count 1 burglary, a level 4 felony.
According to the affidavit of probable cause, on Nov. 15, 2016, an officer spoke with two individuals who claimed that sometime during Nov. 14 or Nov. 15, unknown subjects had forced open their patio window, entered their residence and stole items, including an Xbox One, a 48-inch Vizio TV, a Switzerland collector coin, cash and a case of Old Milwaukee beer. The items stolen were worth approximately $1,220.
On Nov. 17, an officer spoke with the owner of the residence. The homeowner advised he believed that Sandoval and other individuals had burglarized his residence. According to the affidavit of probable cause, on Dec. 9, an officer spoke with an individual who admitted that he, Sandoval and two others had broken into the residence.
The individual further stated that after the burglary he had been given a bag of drugs that Sandoval had stolen from the residence. Sandoval traded the TV for drugs to a male in Elkhart and sold the Xbox One to Worldwide Pawn in Elkhart. The other two individuals who were involved with the burglary split the stolen cash. Officers were later able to locate the Xbox One at Worldwide Pawn.
Judge Michael Reed found Sandoval guilty of count I burglary, a level 4 felony, and sentenced him to one year in the Kosciusko County Jail. Reed stated he would have no objection to this time being served through work release or community corrections, although Reed expressed doubts as to whether this would be feasible considering the fact that Sandoval currently has pending cases in Elkhart County.
Sandoval received jail time credit of six days. A theft charge was dismissed pursuant to the plea agreement.
