Winona Lake Teen Sentenced For Dealing Marijuana

WARSAW — One of three teens found with heroin and marijuana back in July was sentenced today in Kosciusko County Circuit Court.

Brian D. Adkins, 18, Winona Lake, pleaded guilty to dealing in marijuana, a class A misdemeanor. Charges of dealing in a narcotic, possession of a narcotic and possession of marijuana were dropped.

According to the field affidavit of probably cause, on July 11 an officer with the Winona Lake Police Department conducted a traffic stop on a vehicle driving with a headlight not working.

According to the affidavit of probable cause, while the officer was speaking with the men, he observed the passenger, identified as Matthew K. Hayes, 22, Detroit, Mich. throw something out the window. The officer obtained the items and discovered three plastic bags of heroin. The officer could also smell the odor of burnt marijuana coming from the vehicle.

A search was then conducted on the vehicle. In the glove compartment, officers found four plastic bags of marijuana. Under the driver’s seat, officers found a box that contained 33 empty plastic bags. In the trunk of the vehicle, officers located two plastic bags and scales. And in a drink cup, officers located a plastic bag of 4.6 grams of marijuana floating on top of the drink. A total of $316 cash was also located.

Adkins’s attorney, Scott Reust, told the court that Adkins had been compliant with officers, admitting on the scene that he had smoked marijuana.

Judge Michael Reed sentenced Adkins to one year in the Kosciusko County Sheriff’s Department. Adkins received a total of 176 days credit for time served; the balance of that sentence was suspended to be served on probation.

Hayes is scheduled for a pre-trial hearing later this afternoon for this incident. Marco A. Cleto, 19, Warsaw, is scheduled for a plea hearing Nov. 20.
