The man accused of driving drunk and brutally killing a horse has been scheduled to appear in court.

Francisco J. Gonzalez, 24, of Warsaw, is on the Kosciusko County Superior Court III docket for 1 p.m. Thursday, Oct. 18. He is accused of crashing his vehicle into a horse pulling a wagon carrying five Amish teens. The impact killed the horse and tossed all five youths from the wagon. None of the boys were hurt.

The Amish boys and witnesses to the Saturday night crash said it appeared Gonzalez intentionally struck the horse. Floyd Miller, the father of 17-year-old Andrew Miller who was driving the horse-drawn vehicle, also said the boys told him it appeared to be a deliberate act.

Gonzalez reportedly drove around the horse-drawn wagon, made a U turn in the Walmart parking lot, and allegedly accelerated straight into the animal.

Warsaw Police, however, report that none of the victims or the witnesses say it was intentional.

Gonzalez left the scene of the accident and was found by police approximately 3 miles away when his badly damaged car died. He was covered in blood from the horse and had a cut on his head.

Medics transported Gonzalez to a Fort Wayne hospital where a blood draw was obtained showing he was operating with a blood alcohol content of .17 percent.

Kosciusko County Prosecutor Dan Hampton has so far only charged Gonzalez with failing to stop after an accident causing serious bodily injury, a class B felony; and causing serious bodily injury when operating a motor vehicle with a BAC of .08 percent or more, a class D felony.
