Daniels Praises Ruling Overturning EPA Rule

INDIANAPOLIS (AP) — Gov. Mitch Daniels is praising a federal appeals court ruling overturning a regulation clamping down on power plant pollution that contributes to unhealthy air in neighboring states.

Daniels says the ruling Tuesday “is great news for Hoosier ratepayers and job seekers.” He says it means that Indiana’s affordable energy costs can remain one of Indiana’s “best arguments in attracting new businesses.” Daniels also says Indiana complies with federal clean air limits.

The U.S. Court of Appeals for the District of Columbia Circuit ruled 2-1 that the Environmental Protection Agency’s cross-state air pollution rule exceeded the agency’s statutory authority. The court faulted the EPA for imposing “massive emissions reduction requirements” on upwind states without regard to limits imposed by law.

Indiana receives nearly all of its electricity from coal-fired power plants.
