WARSAW — Todd J. Guiff, 45, 10416 N. Green Ave., Syracuse, is back behind bars after he failed to appear for sentencing on Aug. 31, on charges in two different cases. Guiff was arrested by police Monday morning, Aug. 21.

Guiff had entered a plea agreement on two different cases: possession of a narcotic drug, a level 6 felony; dealing marijuana, class A misdemeanor; and forgery, a level 6 felony theft, a class A misdemeanor; and fraud, a level 6 felony.

The plea agreement on the possession and dealing charges had a sentence cap of one year of incarceration with any additional time to be served on probation.

The plea agreement in the forgery, theft and fraud case, agreed he would plead guilty to forgery and theft, with the fraud charges dismissed. His term of incarceration would run consecutive (one right after the other), with no more than two years of incarceration and any remaining term to be served on probation. It was also noted the sentence would be concurrent (served at the same time) with the possession and dealing charges.

In both court matters, the cases were scheduled for plea acceptance and sentencing in Kosciusko Circuit Court on Aug. 31. However, Guiff failed to appear and warrants were issued.

The possession of a narcotic drug and dealing marijuana, stemmed from an Aug. 6, 2014, case where Guiff offered to sell marijuana and oxycontin prescription pills to an informant. A search of Guiff, by police, found 10 oxycontin pills and a plastic bag containing what tested positive for marijuana.

The original fraud, forgery and theft charges stem from a report on March 1, when Angela Scott reported she believed she forgot her ATM card after using it at KeyBank on Feb. 28. She reported on Feb. 28, she found a purchase was made at Wal-Mart for $146.38 and a $30.70 purchase at Lassus Brothers. She told police she did not use her card, nor give any one permission to use her card at those locations.

Surveillance video from Wal-Mart showed a while man purchase a Duramax battery and motor oil. That same individual was shown purchasing gas for a vehicle, he was seen driving at Wal-Mart.

Photographs of the individual were obtained and Guiff was identified as the suspect. Guiff told police he found the credit card and used it to make those purchases.
