Warsaw Man Arrested After Child Shoots Firearm Into Neighboring Residence

WARSAW — A Warsaw man was recently arrested after he told officers his child was the one responsible for shooting a gun into a neighboring residence.

Kyle R. Wuchter, 28, 920 Anchorage Road Lot 25, Warsaw, is being charged with dangerous control of a child, a level 5 felony, and neglect of a dependent, a level 6 felony.

On Jan. 5, an officer with the Warsaw Police Department responded to a shots fired call. The officer observed a bullet hole in the kitchen wall of a residence. The expanded bullet was located inside the freezer and photographed. The residence was occupied by two adults and three children at the time when the bullet was fired into the residence.

The officer then searched the area to locate where the bullet was fired from. According to the affidavit of probable cause, Wuchter approached the officer and advised that the bullet had been fired from his residence by a child. The officer went to Wuchter’s residence and was observed the firearm that was used, a rifle.

Wuchter advised that he, his wife and their daughter were watching television in the living room while the other child was alone in a separate room that contained the firearm. According to Wuchter, the firearm was unloaded but the ammunition was kept in the same closet that the rifle was stored in. Wuchter claimed that the child located the rifle, loaded it and fired it in the room with the door closed. Wuchter’s wife confirmed this series of events.

Wuchter further stated that he had taken the child to a shooting range in the past and that the child knew how to load and unload the rifle.

Wutcher was booked into the Kosciusko County Jan on Feb. 22, with a $10,250 surety and cash bond.
