Cafe Mod Ordered To Pay $53,000 In Back Rent

WARSAW — Courthouse Coffee LLC, known as Cafe Mod, which was located in the Kohls Plaza and closed in December 2017, has been ordered to pay $53,000 in back rent.

In June, IRC Warsaw, LLC filed a complaint for breach of contract and eviction with Kosciusko Circuit Court against Cafe Mod which was located at 622 West CR 300N, Warsaw, and Matthew Hoskins. The original complaint sought $42,283.02 in back rent.

An agreed judgment order was filed on Dec. 12. The judgment ruled in favor of IRC Warsaw and required payment of $53,000. The judgement stated that within 21 days of the filing, a $1,000 certified check must be paid to IRC Warsaw. The rest of the money is to be paid in 34 monthly installments of $1,500, and one final installment of $1,000.

Court documents state that on June 20, 2013, IRC entered into a lease with Courthouse Coffee that in consideration of payment of rent, IRC would lease certain property to Courthouse Coffee. The document noted Courthouse Coffee has defaulted its obligation to pay monthly rent, common area maintenance fees, property taxes and other charges.

IRC notified Courthouse Coffee on June 11, demanding the company to comply with its obligation to pay outstanding rent to cure its default within 10 days from the notice. Which, according to documents, Courthouse Coffee is not due, causing a default with IRC allegedly having the right to terminate Courthouse Coffee’s possession rights. Documents also note Courthouse Coffee is unlawfully withholding possession of the premises from IRC.
