MARSHALL COUNTY — A family is suing the driver of a truck that hit a school bus, killing a student.

The mother of 13-year-old Owen Abbott filed the wrongful death suit Tuesday.

Abbott died one week ago after a truck slammed into the back of a school bus along U.S. 31 in Marshall County.

The school bus had stopped at a railroad crossing when the truck hit the back of the bus.

The bus was on the way to a school holiday outing.

The lawsuit claims the truck’s driver was negligent by failing to obey the bus’ stop arm and failing to maintain control of his vehicle.
