WARSAW — It was noted that a stalemate exists with one of the properties discussed at the code enforcement hearing held yesterday, May 15, as neither the property owner or tenant are willing to address the general nuisance issue.

The property at 1627 Fisher Ave., Warsaw, is owned by Brad Eberly and rented out by a tenant. The property has had code violations since the beginning of 2017 including general nuisance and unplated vehicles. It was noted that the trash and debris outside the residence continue to worse as time passes.

City employees have talked with both the tenant and Eberly multiple times. Eberly has confirmed his address but has not picked up any of the certified letters the city has sent him. The tenant advised a city employee that he would not be cleaning up any of his trash until the owner fixed the inside of the building, which the tenant says has broken water pipes and mold. Since neither the owner or tenant are making any progress, the property was described as a stalemate.

City Council Member Jerry Frush was present at the hearing to attest to the worsening condition of the property. “Nothing seems to be getting done,” said Frush. “I’d like to see something done here.”

Hearing Officer Thomas Earhart stated he needed some time to review his options with the property, which was taken under advisement.

The property at 1825 Michaels St., owned by Virginia Adams, was new to this month’s docket. Richard Walls was present at the meeting and advised that he is in the process of buying the home from his mother, Adams. The city had received general and environmental nuisance complaints regarding the property.

It was noted that the property is now at about 80 percent compliance and Walls is continuing to clean up the property. A few problems existed such as high grass and a vehicle that is not plated being used as a storage space. The property was continued until the hearing on June 26.

• The abandoned car wash at 2516 E. Center St., owned by Dash Mesh, has made no progress. The order of demolition has been recorded with the county.
• The property at 812 E. Arthur St., owned by PC Properties and Rentals, has re-roofed the residence. The property was listed as in compliance and taken off the hearing docket.
• Work is continuing at the 519 N. Park Ave. property, owned by Faviola Duran. A contractor has been hired and making progress. The property was continued until the hearing on June 26.
• The property at 3521 Lake City Highway, owned by Hari Om Inc., Warsaw, is almost up to code. The final painting is being done on railings and spindles. The property was continued until the hearing on June 26.
• The property at 1422 E. Main St,. owned by Stephen Moore, is still in the beginning phases of foreclosure. Moore was reminded to keep the exterior of the property free of debris and the lawn mowed. The property was continued until the hearing on June 26.
