WARSAW — A Warsaw man was sentenced today in Kosciusko Superior One Court after threatening police officers in June 2017.

Toby Daniel Jackson, 35, 30 EMS B34 Lane, Warsaw, was charged with intimidation, a level 6 felony; and disorderly conduct, a class B misdemeanor.

On June 3, 2017, officers responded to a report of a verbal altercation between Jackson and a female subject. According to the affidavit of probable cause, Jackson made threats to officers.

Jackson also threatened to give one officer a black eye. When arrested, he told an officer that he had better get a spit hood because he has Hepatitis C and was going to spit on the officer and bite his face.

He also made threats to burn the officers’ houses down.

Deputy Prosecutor Brad Voelz said that Jackson has a history of substance abuse, particularly with alcohol.

He said that the majority of incidents within Jackson’s substantial criminal history have been related to alcohol abuse.

Defense attorney Scott Lennox stated that Jackson is fully aware of his issues and is currently in an anger management program at The Bowen Center.

“I wrote letters to the officers and apologized,” Jackson said. “I want to take more responsibility of my actions.”

Judge David Cates sentenced Jackson to one year in custody, but said that his sentence could be served with the Michiana Community Corrections.

Cates stated that during that time, Jackson is not allowed to have any alcohol and must continue his counseling. If he violates anything, Jackson will be taken into custody at the Kosciusko County Jail.
