Woman Facing Criminal Recklessness Charge After Firing Gun Inside Home

CROMWELL — A Cromwell woman is facing charges after she fired a gun inside of a residence after intimidating her husband.

Dawn M. Hardesty, 46, 11117 N. Polyanna Pike, Cromwell, is being charged with intimidation with a deadly weapon, a level 5 felony; criminal recklessness while armed with a deadly weapon, a level 5 felony; and pointing a firearm, a level 6 felony.

According to the affidavit of probable cause, an officer with the Kosciusko County Sheriff’s Department responded to a woman firing a gun inside of a residence on Aug. 5. When the officer arrived on scene, he observed Hardesty running towards the road. She was detained until the situation was under control.

The affidavit states that the officer entered the home and spoke with Hardesty’s husband. The man stated that he was in a room in the back of the residence locking up his guns when Hardesty came in and pointed a gun at him, saying, “If I wanted to kill you all I got to do is this.”

The husband further advised that Hardesty left the room and began arguing with their son before he heard a gunshot. He advised he entered the room and helped disarm Hardesty when the gun was fired again. One shot went through the ceiling and the other struck the refrigerator.

According to the affidavit, the officer then spoke with the son who stated he witnessed Hardesty load a bodyguard 380 handgun and point it at his father. He stated that Hardesty made several threats and he had attempted to disarm her. It was during the struggle to disarm her that the gun was fired the first time before the husband entered the room.

When the officer spoke to Hardesty, she simply stated that she had grabbed her handgun and while in the living room her son grabbed her, causing the gun to discharge. While struggling with her son, the gun discharged a second time and she let go and ran outside.

Hardesty was booked into the Kosciusko County Jail on a $10,250 surety and cash bond.
