WARSAW — The third and final suspect of a November 2016 home invasion was sentenced today, June 5, in Kosciusko Circuit Court.

Jwain A. Sullivan, 23, Warsaw, was sentenced to six years at the Indiana Department of Corrections. Two of those years were suspended to be served on probation.
According to police documents, on Nov. 7, 2016, Warsaw Police responded to Oak Brooke Place on the east side of Warsaw for a home invasion that had just taken place.
The homeowner told police that her neighbor, Daricus Phillips, knocked on her door asking if her nephew was there, to which she replied that he was not. A few moments later, Phillips again knocked on the door and when the homeowner answered, Phillips and Sullivan forced their way into the residence asking again for her nephew and asking where the money was.
After responding that there was no money, Sullivan struck the homeowner in the face with an crowbar wrapped in a towel. The homeowner and the intruders argued and woke the homeowner’s fiancé who confronted the intruders and he was also struck in the face with the crowbar in the towel. The intruders eventually fled after taking a Playstation 4, a cell phone, cash and some marijuana.
Police searched the area and found Phillips and his girlfriend, Taylor Brandon, at a nearby gas station and took them into custody and interviewed them. A consensual search of cell phones found messages of drug activity between the homeowner’s nephew and the suspects.
Sullivan’s attorney, Antony Garza, told the courts that Sullivan was very remorseful for what had happened. Sullivan stated that as his sentencing date approached, he had become scared of leaving his family and young daughter.
Judge Michael Reed was the first to point out that this is Sullivan’s first criminal offense. “I feel like this is out of character for you,” stated Reed. “It’s sad it had to be such an awful offense.” Reed continued by saying it was clear the home invasion was not planned by Sullivan.
Sullivan was sentenced on a charge of burglary, a level 4 felony, a lesser included offense of the original level 2 felony. Per the plea agreement, charges of robbery resulting in serious bodily injury, a level 2 felony; two counts of battery by means of a deadly weapon, level 5 felonies; and a class A misdemeanor theft were all dropped. Sullivan will receive 19 days jail time credit.
