Syracuse Town Council Amends Noise Ordinance

Syracuse Town Council approved amending the noise ordinance during its regular monthly meeting Tuesday night.

The ordinance now reads:

The following acts are declared to be violation with the exceptions listed in each category.

A) Loud, continuous noises generally. The making of or continuing or causing or aiding to be made or continued, any loud, unnecessary or unusually noises whatsoever, which either annoy, injure or endanger the comfort, repose, health or safety of others, unless the making or continuing of the same is necessary for the protection or preservation of property, or the health, safety, life or limb of some person.

B) Sounding horns. The sounding of any horn, signal, device, whistle or attachment on any automobile, motorcycle, bicycle, truck, bus, railroad engine or other vehicle, except as a necessary warning of danger to persons or property.

C) Fireworks or other pyrotechnic devices. The use of fireworks and pyrotechnic devises shall be used in accordance with Indiana law.

D) Musical instruments generally. The creation of loud noises by the manipulation, handling and playing of musical instruments, or bands at businesses or private parties shall play no later than the hour of midnight on Friday and Saturday nights, adding Sunday nights if it is a holiday weekend and 10 p.m. the remainder of the week.

E) Sound trucks or public address systems. The creation of noises by the use of radios, sound trucks, public address systems or similar devices, upon the streets or public places of the town, or the use of any such devices or of any window tapping or rattling devices upon or from any building or private property for the purpose of advertising or attracting attention; provided, however the town police may use a sound truck or public address upon the streets and public places for the purpose of directing, informing or educating all vehicular traffic upon the streets and public places.

F) Radios, phonographs, Victrolas or other musical instruments or noise. The creation of noise by any radio, phonograph, Victrolas or other musical instrument or the making of loud, unnecessary or boisterous noises at any hour whatsoever of the day.

G) Quiet time. The Town of Syracuse shall uphold a “quite time” between the hours of 10 p.m. and 8 a.m. during the week and midnight and 9 a.m. on weekends and national holidays.

It is hereby ordained that the town code of the town of Syracuse be amended by adding the following as section 6-218 and repealing the previous section 6-218:

Enforcement Penalties

A) Any person found to be in violation of this article shall be give a verbal warning for the first offense. Thereafter, an ordinance violation citation shall be issued and a fine assessed in the amount of $25 for the second offense; and a fine for $75 shall be assessed for a third offense and for the fourth and all subsequent offenses, a fine of $150 shall be assessed.

B) Violations shall be counted within a calendar year beginning Jan. 1 and ending Dec. 31 of each year.
