Brothers Settle Robbery, Beating Cases

Initially arrested for allegedly brutally beating a victim during a robbery, two brothers recently had their cases settled in Superior Court I.
Brothers Bryan E. Frush, 26, and Austin John Frush, 19, both of 109 E. Elm St., Pierceton, were arrested in October, accused of robbing a man of $20 and marijuana and beating him.
The victim said the attack happened on Sept. 29, 2013, after a night of smoking marijuana with the brothers. The victim said one of brothers kicked him while Bryan Frush put him in a choke hold, causing him to nearly pass out. Two witnesses ran to the victim’s aid while the brothers were said to flee the scene in a minivan at a high rate of speed. (See related)
Both Bryan and Austin Frush were charged with Class A felony robbery causing serious bodily injury, Class C felony battery causing serious bodily injury and Class D felony strangulation.
On April 1, Superior Court I Judge Duane Huffer dismissed all charges against Austin Frush.
On April 24, after accepting a plea agreement, Bryan Frush was sentenced for a single Class D felony count of strangulation. He was sentenced to 1 1/2 years in the Indiana Department of Corrections, but given credit for 155 days served. Additionally, Judge Huffer then suspended the sentencing, placing Bryan Frush on probation for a period of 6 months.
Bryan Frush is also responsible for restitution to the court and the victim in addition to paying for probation user fees.
