Duffy’s Sued Over Barroom Battery

Duffy’s Pub & Grub in Syracuse is facing a lawsuit following a battery that occurred there in 2012.

According to documents filed with Kosciusko courts, on July 8, 2012, Christina Golden was a patron at Duffy’s Pub & Grub. Another patron, Jonathon Heckaman, one of the defendants in the lawsuit, allegedly began taunting and harassing Golden.

Heckaman is purported in the lawsuit to be prone to violence and excessive drinking. At the time of the incident, Heckaman was allegedly intoxicated, either from being over-served by Duffy’s staff or being served while already intoxicated.

Golden asked Heckaman to leave her alone. Golden claims the staff at Duffy’s took no action and that Heckaman was allowed to continue harassing her.

At some point during the interaction, Heckaman kicked Golden in the abdomen without provocation. Duffy’s staff neither called an ambulance nor the police and offered Golden no assistance.

After returning home by her own means, Golden began coughing up blood. She was transported to IU Goshen Health Emergency Room by family members.

Since her initial ER visit, Golden has required additional treatments and procedures that she said is related to the assault by Heckaman. In the court documents, Golden asserts that Duffy’s failed to provide a reasonably safe environment, and Heckaman struck her in a manner causing her serious injury, including permanent physical impairment and scarring.

Golden, represented by Birch Law Firm, is suing for “an amount reasonably sufficient to compensate her for all damages suffered as a result of Defendants’ negligence,” in addition to other fees.

Heckaman’s assault on Golden did constitute criminal battery and, as a result of his actions, he was convicted in April 2013 of battery causing bodily injury, a Class C misdemeanor, in Kosciusko Superior Court II. Heckaman was sentenced to 365 days in jail, all of which were suspended upon the condition he submit to substance abuse evaluation and pay fines totaling approximately $400.
