Not satisfied with a ruling that would have the former executive director of the Kosciusko Board of Realtors paying back only a fraction of what she stole, Prosecutor Dan Hampton says a hearing on the matter will be held in the near future.

In Kosciusko County Superior Court II on June 20, Elizabeth Kennedy, 52, was sentenced to 3 years in prison. Half of that term was suspended, meaning Kennedy will be on probation for that time.

At her sentencing, Judge James Jarrett also ordered Kennedy to pay $330 in court costs and make restitution to the KBOR in the amount of $1,418.78. The problem with that sentenced, according to Hampton, is that Kennedy pleaded guilty to two D felony charges of theft and admitted to stealing an estimated $28,000 over the course of 4 to 6 years by making unauthorized personal charges and purchases with the company account.

According to Hampton, a hearing regarding the sum total of Kennedy’s theft was held within the last two weeks between the prosecutor and Judge Jarrett. Hampton filed a motion to add additional evidence to Kennedy’s case and to seek restitution for the full amount she admitted to stealing. Jarrett agreed to another hearing on the matter, but said he wanted Kennedy present.

Hampton intends to submit additional evidence including the KBOR’s records of the stolen funds and Kennedy’s admission to Warsaw Police detectives who investigated the case and made the arrest.

During the investigation, police say purchases were made by Kennedy from the KBOR funds for herself, her family, and an acquaintance. Kennedy then manipulated funds from the organizations different accounts to hide the thefts.

Kennedy is due to be released from the Rockville Correctional Facility on March 19, 2013. No date for the hearing has been set.
